1. Appointment as Private Ministerial Agent
Tertia Club operates as an independent private reservation utility. By enrolling or configuring routines, you formally appoint Tertia as your authorized digital agent to execute reservation and spot-release requests on your behalf, strictly in accordance with your instructions.
Under established English common law (Said v Butt; Lifestyle Equities [2024]), actions performed by an authorized agent within the scope of actual authority are legally attributed to the principal. Tertia exercises no independent discretion over your bookings.
2. Independence & Non-Affiliation Disclaimer
Tertia Club is an independent software utility. Tertia is not affiliated with, sponsored by, authorized by, or partnered with Third Space London (Third Space Ltd) or Fisikal Ltd.
All club names, trademarks, and brand assets referenced on this platform remain the exclusive property of their respective proprietors, referenced solely to identify the venues and class schedules to which member-directed routines apply.
3. Personal Quotas & Zero Commercial Resale
Tertia executes requests strictly within your native membership quotas (maximum 1 concurrent reservation, 3 daily bookings). All reservations are booked in your personal name and membership ID.
Tertia maintains zero proprietary ticket inventory, charges zero ticket markups or booking commissions, and facilitates zero secondary transfer or resale. Bookings represent bona fide personal consumption.
4. Club Rules & Member Risk Allocation
You remain independently bound by Third Space London Membership Terms & Conditions, including class cancellation deadlines and strike rules. Tertia does not guarantee studio capacity for requested sessions.
Third Space London reserves unilateral discretion regarding its booking systems and may restrict privileges for automated assistance. Tertia accepts no liability for club strikes, penalties, booking restrictions, or membership actions.
5. Credential Security & Data Protection
Member credentials are encrypted at rest using bank-grade AES-256-GCM envelope encryption with unique initialization vectors. Plaintext passwords are never stored or logged.
Personal data is processed strictly under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, solely to execute your configured routines, and is expunged upon account deletion.
6. Subscriptions, Cancellations & 14-Day Guarantee
Subscription fees are billed on a recurring monthly or annual basis via Stripe. All subscriptions include an unconditional 14-day cancellation and full refund guarantee upon initial enrollment.
You may cancel recurring subscriptions anytime with a single click from your member dashboard. Routines remain active through your paid billing period without further renewal charges.
7. Limitation of Liability & Governing Law
The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, aggregate liability is capped at subscription fees paid by you to Tertia in the preceding twelve months.
These Terms are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any disputes.
